without any just or legal provocation, as I have learned from a num- ber of eye-witnesses of the fact .oicCarley, was immediately arrested by a warraut from under the hand of Wm J Hamilton a lawful & acti11g justice of the Peace, by J F Wheat a Deputy Sheriff of this county, whose custody, before coming to trial, he broke, & flecl, it i- supposcd to Arkansas As, Red Rirer, the line between Texas & the U 8tates, bounds this couuty, refugees, mny, in a few hours, get be- yond our jurisdiction & elude their just & merited punishment entirely; ~ud the only hope that they may be brought to justice, is through the mstrumentality of your Excellency's reward. I hope, therefore, that you may give the benefit of it to our community in this case; that the ~ccused may abide the law, whether he be guilty, or whether he be mnocent. The said l\IcCarley is about 28 or 30 years of age, 5 feet, 8 or 10 inches in height, heavy built, dark hair, dark eyes, & tolerbly fair complexion. It is supposed he has fled to Arkansas I would also here further state, that at our ~larch Term of District Court for this county iu the present year the Grand Jury found a "true Bill'' of murder against one William II Hopkins, ha\'iug com- rnittecl the same upon the body of one Eldred Fields (both citizens of this county-in the summer of 1839) & fled, it is supposed, to Arkansas. The process upon said indictment, was returned by the Sheri.ff "non -est invertus" The attrocity of this deed cries aloud for Justice & aid Hopkins is about 35 years of age 5 feet 7 or 8 inches high thick set round shouldered, dark hair, dark eyes & dark complexion. Having been informed that Congress at its present Session had passed a law authorizing the Surveying of the Cherokee lands within the Ter- ritorial limits of Texas and being desirous to obtain a contract to survey a part thereof, I take the liberty to address this to you. I pro- posed to take a contract that will give me employment for Six months and take of the government, land cirtificntes to be located on any un- occupied lands of Texas for the whole of my ser\'ices O\'er and nbo\'e what may be actually necessary for the ordinary expences of the hnncls, as hire, food &c. · I have had some experience in Surveying for the oflice of usun·eyor General for the States of Missouri & Illinois"-in this office I hnw, otherwise, been employed for fh·e years, draughting & Copying & u~•- derstand the whole business- I would like to obtain employment Ill the office of the cornr. of the genernl Land olncc of Texa:;-& will tnke
