I am in this place for the purpose of attending the Session of the- Dist court which comes on the day after tomorrow- His honor . Wm J. J. has already reached here- He has given unh·ersal Satis- faction. May he continue to do so- I say this with but one excep- tion- The case of the "case of the board of Land Commissioners of Fort Bend county adversus the Boar·d of General Commissioners west of the Brasos" (See Richmond Telescope & Register under date of the 11th of April Inst). The report of the local commissioner) was made a part of the petition for the mandamus & hear the reasons of the court; would you not say that the ma.tidamus would be granted? I presented the matter before the court on its merits; argued and urged its importance the judges opinion is a fair synopsis of the heads of the argument- How could he refuse the mandamus? He has Shown you- No counsel oposed the reasoning nor the argument the Judges- decision is purely his own-and the reasons with him were originaf and entirely sufficient for refusing the mandamus- I hnve done here; with Judicial matters and with Judge Jones whom I esteem very much and who is destined to figure in the history of Texas jurisprudence as one of its brightest Stars. Should he not fall out of the way he is going- I left home two days since and w.ill return directly court is over here
