I take the earliest opportunity of informing your Excelency that a due regard to my own interest forbids my accepting the office of Chief Justice of Bastrop County which your Excelency has been so kind as to Confer upon me at the solicitations of some of my friends & fellow citizens- I am induced to do so for the two fold reason that there are others desirous of the appointment to whom the office may prove bene- ficial who would be excluded by my acceptance without benefiting myself-nay rather it would prejudice my interest. The nomination was made under circumstances that prevented my being consulted & without the knowledge-of the fact that it would be impossible for me to accept of the appointment I sincerely hope that this explanation will be satisfactory to your Excelency of a course of procedure that might, otherwise seem strange fickle_& irregular.
