table linnen, one Lot of Silver Consisting of tea & table Spoons, forks, drinking Cups-a Lot of crockery ware- a Lot of glass ware- kitchen furniture-a Lot of books-one dressing case, and one portable writing desk-to have and to hold the same forever Provided always, and the condition of these presents is such, that if I the said Richd R Wilkins, shall pay to the said :Mirabeau B Lamar the debt aforei:;aid, with the interest, on or before the first day of Jan- uary next then this instrument shall be void and of no effect. And I the said Richd R Wikins agree to pay the same accordingly- But if default be made in such payment, the said Mirabeau B Lamar is hereby authorized to sell at Public auction, after the like notice as is by Law required for Constables sales, the articles herein before men- tioned, or so much thereof, as may be necessary to satisfy the said debt, interest, and reasonable expenses, and to retain the same out of the proceeds of such sale: the overplus or residue, if any, to belong and be returned to me. And the said 1\Iirabeau B Lamar is hereby authorized to take pos- session of the afore mentioned furniture on or before the first day of January next, uniess the said debt shall be sooner paid In witness whereof I have hereunto set my hand and seal the 18th. day of May A.
