No. 1067. JAMES S. 1\IAYFIELD AND OTHERS TO LAM.AR Nacogdoches 13th February 1839 To his Excellency 11'IrnEABEAU B. LAMAR City of Houston Dn Srn The undersigned having just learn.ed of the death of Judge Cor- zine, and of the application of several individuals from San Augustine County whose qualifications to fill the vacancy in the office of Judge of that District are at least problematical, if not wholy unsuited for such a station-more particularly when under our judici"ary system it will l.,e recollected-the district judge becomes one of the members of the Supreme Court--'-and should possess when imch can be wocured char- acter of a high moral grade and legal attainments of a like high order. It is believed neither of the gentlemen who are applicants from St- Augustine possess the necessary qualifications in so eminent a degree as Warner L. Underwood, formerly of Kentucky, who stood high in his profession there. He is moreover it is believed not per- sonally interested in the principles involving the great land interest of the Country-so essential in saving a judge at least from suspicion of adjudicating for his own interest. The undersigned would view the appointment of Mr Underwood to fill the vacancy alluded to an acquisition to the country and fully satis- factory to the people of the District over which he would have to preside With high respect we are your Excellency's 11fost obt Servts J .AS.
