On your table is an act creating the county of Harrison. That it will recei,·e your signature I am not permitted to doubt. It will greatly facilitate the organization of the militia which duty by an act passed by this congress now devolves upon the Executive Thomas Timmons is the individual that will be most acceptable to the citizens of that portion of the Republic for Chief .Justice. In this opinion. my Colleague :Mr A. R. Johnson concurs :Mr Timmons is about fifty years of age has much experience in business and will be for intelligence perhaps equal to any chief Justice in this Republic and Superior to many. You will please recollect that there is an act or Resolution on our Statute books requiring the Chief Justice to be sworn into office by the members of the county; and let me suggest to your Excellency the propriety and importance of Sending the com- mission to myself or colleague immediately an<l. if sent to me I will ex officio interest myself in calling promply on l\Ir Thomas Timmons and administering the oath office In the county of Shelby .and the new county of Harrison I will in a few days after I reach home write and signify who woulcl be most suitable to aid you in organizing the Militia. I will write you soon on the subject of the boundary line. I will now however add that I should be extremely gratifyed If in your care- ful judgement you sholcl give me that appointment. ~fr. Griffith wishes me to say to you that if Dr. Kelton does not chose to hold the office of Notary public for this place, that he would be pleased to acept it. Should you have to make another appoint- ment for Galveston, & have no one else in view, I think you would do well to appoint him. His present office of Impost Clerk will allow him sufficient leisure to attend to the duties of Notary, and no one could do the business better. Olivea is improving in health. Yesterda~· she was so unwell tl~at I found it necessar_v to bleed her pretty freely. It has been of service to her. She took a ple!lsant ride this evening of four or five miles <lown the Leach & feels the better for it. We have the use of a horse
