Augustine became meant and was filled in accordance with the C'onstitutio11 by the ExecutiYe at the spring Session the indi,idual was nominated by the Executive and was re- jected by the Senate, the Exec:utiYe failed to make any other nomina- tion at this congress he has not nominated any other person, the in- di\'idual yet holds the office, I do not know what is the regular course to persue but lay ·these facts before you, as I do not believe San Augustine has a lawful chief justice If you should coincide with me in opinion I would beg leave to recommend to your Consideration :Mr. K L. I beg leave to introduce to your acquaintance and to reccommend to your friendly attention l\fr. Henry S. Jlays by whom this will be handed you and who has emigrated with his family from South Caro- lina with a view of settling permanently in Texas.- I have not myself the pleasure of a personal acquaintance with ::\Ir. l\fays,-but I un- hesitatingly take the responsibility of reccommending him to you from my i11timate knowledge and high esteem of his brother Col. Hobert C. )lays of this County at whose instance I now write.- There is an- other circumstance which I h.,1ow will interest you in behalf of :Mr. )[ays.-He had a brother, Samuel A. J. Mays who was a member of the "Georgia Battalion'' and fought and suffered ancl fell along with Fanning, ancl Ward and their braYe c:ompratiots. That brother, it is understood, was entitled to an allotment of land from your Govern- ment. on account of his i:Crvices, and among other things, }fr. l\Iays and the other persons interested in the succession to the deceased, will be greatly obliged to you for so advising him as best to secure and reduce to possession their rights in this land.- For such a11Cl all other attentions a11d assistance you may have it in your power to extend to 1lr. )fays, 1 shall feel myself, per:a:onally, plac:cd under obligations to YOU. \\'ith the hi~hcst Consideration Your frieml & Obt.
