As it is probable that the question will be caJ}ed up at this session of Congress respecting the Chief Justiceship of this County, and whether or no my appointment to that office may be confirmed I can- not tell, but this much it [was l well understood when this County was stricken from Nacogdoches that I was to receive the appointment of Chief Justice by both Houses of Congress ancl for that reason the President ga,·e me the appointment the office is not Lucrative, Lut as it was the appointment of the executive and as I have had all the trouble of organising the County and preparing the public Buildings &e. I should think no more than even handed Justice that I should be sustained in the office. I will assert this much that most of the Judicous aud respectable part of the County are in favor of my being sustained, it [is] quite probable that I will not be nominated as our representative and myself differ a little in our political opinions we will recollect one thing we were side and side at the trying time as you remarked to me on Your last t~ip out there has a petition gone . . .
