Acres 248,201 For further explanation of the preceeding I have the honor to submit a copy of the Power of Attorney to Thomas Toby ES<{ and Thomas Toby & brother and also transcripts of several corresponding communications made to them by the Government, and a facsimile of the scrip issued. The contemplated expedition against Matamoros with the large requisition from the commanding General for army supplies, rendered it necessary to put forth every means within the power of the Government to exert. Accordingly a second authorization was tnnsmitted by letter to Mr. Toby, to issue Scrip for 500,000, additional acres making his whole authority to comprise One Million of acres. The scrip on the last intended issue was directed to be struck off in a form to emanate directly from the Government and lo be sent out for signature here, by the Executive and the Secretary of the Treasury, and then returned to the Agent for disposal. Mr. Toby has also been requested to send out for signature such portion of his first issue as had not yet been executed and desposed of; but to continue his sales, as before, until the new Scrip could be returned. In compliance with these requests Mr. Toby has transmitted a quantity of blank scrip comprising 516 certificates of 640 acres each styled FIRST and 482 certificates of 640 each styled SECOND: fac similies of which are herewith transmitted:-and which remains in this office. Of this Scrip the new series we have recently issued 16 certificates to Colonel Sidney Sherman who had been, some time previously authorized to repair to the United States on public business and was detained by serious indisposition until very recently. It will be observed that the whole amount of scrip sent out, added to the quantity issued by Mr. Toby will exceed the aggregate number, one Million of acres authorized to be issued. This surplussage I pre~ume was inteded to provide against
