erence to Mr Webster, provided she shall decide upon so doing within three days, and shall deposit the purchase money of ninety thousand dollars at San Juan del Norte by the 20 of next month. If Mr Webster's exposition to this government has not been misconceived, Nicaragua cannot but feel some mortification and regret that such a step should have been taken by a Sister State, without the knowledge or consent of this Republic whose rights and interests are so immediately effected by it. It cannot be unknown to Costa Rica, that Nicaragua claims the exclusive right to the Steamer Virgen, by virtue of having captured it from her enemy, and that she has not only never parted with that right but has never ceased, for a moment to retain possession of said Stearne [sic]. She is, therefore at a loss to conceive by what ·authority Costa Rica could have sold 3 " disposed of the same by sale or otherwise. Besides, it is known that the right of property in the Carlos remains an unsettled question; in consequence of which it has been agreed by the two nations that said steamer shall be considered as being in the joint possession and shall bear the flags . of both countries until the question of ownership is adjudicated. Neither power, therefore, can rightfully sell said Steamer, without the consent, & ratification of the other. Nicaragua conceives that she has other just cause of complain[t] in the two conditions contained in the contract w_ith Mr Webster, first that of allowing three days only to this governmt in which to decide whether it would take the boats or not; and secondly that of demanding the payment at so short a notice. Nicaragua conceives that there are other just causes of complaint against Nica Ragua [sic] in connection with this affair.
