Consul again comes the said Caleb Thurlow and requires me to extend his protest also comes James - Corkhill, Shepherd Shaw, V. R. Bristol and William Eaton, all of whom being duly sworn on the Holy Evan- gelists of Almighty God did severelly freely and solemnly declare, de- pose and say, as follows. On the morning of the 8th. of August 1.858. a soldier came to me at my place of business and told me that the Governor of the town wished to see me, as the messenger did not say what was acquired [sic] of me and I being very busy at the time I replice that I would see the Governor soon. Immediately after the soldier had left, my partner Mr James Corkhill was sent for by the Governor as he was about to go, I told him (my partner) to ask the governor if he wanted me and that if he did I would go as soon as possible. When Mr. Corkhill returned he told me he wanted me, I immediately left the house to go and see what was required of me, I met the Governor in front of the door. I spoke to him and asked him if he wanted me and for what; he replied I sent for you and you did not come and answer my summons I then asked him what were his office hours, and he replied at all hours and because I dit not go when he sent for me he would make me a prisoner, I told him to do so he went up the town towards the Cassock and I went into the house of Mr. Green where I board shortly after I went next door into the house of Dr. Flint and asked him if a person could be arrested in this country unless he was a criminal on a Sunday, he told me I could not I returned to Mr. Green and took a seat and in a few moments after, the house was surrounded by an armed force who wished to enter the house, Mr. Green, told them not to enter his house with an armed force, the active Governor Faustina Arellano then gave the order to his soldiers to let no one pass in or out of the house and that all the persons in the house M. Green, Mr Bristol, Mr Shaw, and Mr Eaton were prisoners, Mr. Green went out of the door and was pushed back by a soldier, he then asked the Governor to permit him to go and see the american Consul and was refused permission, Mr. Green then asked Governor Faustino why he was made a prisoner in his own house, the governor and Mr. Green had some words and I saw the Governor slap Mr Green's face. Mr. Priest the american Consul came and asked to have the guard removed from the door and was refused. - The Governor stated to Mr Priest that Mr. Green and myself were prisoners, we told the Consul that we were willing to go with the guard, Mr. Priest then said to the Governor that he would be securely [sic] for our appearance on Monday morning, but as we did · not thinck we had committed ourselves as criminals we did not wish to give security - Mr. Green and miself were then taken to the prison and remained there for twenty four hours when we were released through the kindness of Capt. John Kelly of the U. S. Frigate Saranac and to the present moment I do not know what was required of me by the Governor. Wherefore the said Caleb Thurlow hath protested as by these presents I, the said Consul, at his special instances and request, do publicly and solemnly protest against all and every person or persons whom it doth or may concern and do declare that the G;overnment of
