to bring in an offset to said demand - that such a right belongs to the principal, and he, as security is equally entitled to the same - a right, which being denied in the Court, he now asks the Legislature to recognise and allow. It does not appear that Gail Borden is insolv- enti.. or that the debt is likely to fall upon his securities - the securi- ties_only ask that they may be allowed to make the proposed offset in order to save them the necessity of raising and refunding the money which had been confided to them for the payment of said demand. Such are the facts of the case as presented to the Committee; and after a due consideration of them, the committee are of an opinion that the petition of Mr McKinney cannot be granted without extending to him a privilege, which has been hitherto denied to others, and one which if granted generally would be detrirn,ental to the public inter- est. ACCOUNT OF A FIGHT OF LIPANS WITH SPANISH TROOPS 9 1820 - A mexican taken prisoner by the Lipans on the Rio Grande, 4th June 1820, made his escape from them on the head waters on colorado the 2nd August 1820, and came to the Presidjo on the Riogrande- He gave the following information,- that on the Colo- rado, the Lipans were attacked by the Tawackanays, about the break of day; he does not know their number; but out of the 80 Lipans who went out to meet the Tawackanays not one escaped; all were killed; - whilst these 85 were engaged with the Tawacknays, holding them in check the rest of the Lipans of the village made· their escape, men women & children, with their cavayard.
