He died early in April 1847 in the City of Mexico, and was the Military Commandant of the City at the time of his death. Hav- ing been placed in that position by Genl. Santa Anna when he left there previous to the Battle of Cerro-Gordo.

[1847 or 1848, M. B. LAMAR TO J. W. HENDERSON. REPORT- To the Hon, J. W. Henderson, Speaker of the House of Representatives. The Joint Committee to whom was referred the Petition of Thos. F. McKinney, having had the same under consideration, have directed me to make the following Report. - The object of the Petition not being definitely set forth, the Peti- tioner attended, (under invitation) a meeting of the committee, and made an explanation of his wishes. From his own representations, the following facts appear - viz - first, that a judgement of Twenty thousand dollars has been obtained against Gail Borden (late collector of customs at Galveston) and his securities, whereof the Petitioner is one; and secondly, that said Borden, in anticipation of this judgement, and for the purpose of meeting the same, placed in the custody of said Petitioner for safe keeping, the sum of fifteen thousand dollars, which money the petitioner appropriated to his individual purposes, and is now unable to refund, without much inconvenience to himself. He, therefore, prays that the Legislature, will allow him to settle said judge-· ment by placing the amount of it as a credit upon the audited claims and accounts which he holds against the late Republic of Texas.
