5. No officer or soldier is to draw pay who has not received orders since the 18th of December. 6. The paymaster can only certify to the auditor, when an applicant may require, the same to be done to what time he was last paid, and in no case is any one to be paid until he has signed duplicate pay rolls, one to be retained by the paymaster and the other to be deposited with the auditor, every two months. 7. No officer is to draw pay for higher rank than that in ,vhich he was commissioned. 8. No certificate can be given by the war department, only as to the date of the appointment or commission and to what date he was in office, and no allowance can be made but in cases [for] which the law has made special provision. 9. The auditors and comptroller are to pass no accounts with- out good and sufficient vouchers. 10. No allowance is to be made for enrolling men, but such as were actually enlisted in the regular service and as such mustered into service, not as volunteers. 11. No allowance is to be made for transportation until the officer had reported in person in Texas and received orders. And no one who was sent to the United States by the government ad interim, nor any one on furlough. 12. No contract can be made by any head of department for more than one thousand dollars, until they are approved by the executive, nor for any amount unless authorized by law. 13. No person is to draw upon any custom house officer or officer of the revenue of the country, but the secretary of the treasury. 14. No head of a department shall use any money appropriated for a specific purpose to any other design. 15. No person can be employed by any head of department or any officer of the government to perform any duties or employ- ment in the army or navy, unless he is an officer of the same: Nor can any person who is now employed be any longer retained in service. 16. The president is to be made acquainted with all important orders, changes and information of the departments of govern- ment or any of their branches. · 17. No account whatever is to be paid by the treasurer until it has passed the auditor and comptroller, nor can any head of department act upon any account until it has passed the auditor and comptroller, further than to certify a fact or facts deduced from records in the office from which the certificate may emanate.
