laws be faithfully executed," do hereby declare that the Comp- troller has failed to ascertain the "average value" of the lands in each and every County of this State for the year 1859, and furnish the same to each Assessor of the State before the first day of March, in the year 1860, and that the list of "average values" contained in his instructions to assessors is not in accord~ ance with law; And it is further declared that that portion of his instructions, which abrogates that clause of the law, allow- ing the value of the lands to be assessed in the Counties where they lie is void and of no effect. And the Said Comptroller having failed to furnish "each Assessor of the State" with the average value of the lands in each and every County of the State, the execution of the law falls upon the Assessors in the various Counties, who will, to the best of their ability, executed the same in all respects. To John S. Bedwell, Buffalo, New York Sir: Your letter of the 16th inst. tendering a Company of men for the Rio Grande service, is this morning to hand. In reply I would state that the Government of the United States having taken this matter in hand, I have now no need of men for the service.
