Sir.- In answer to your question I have to reply that if Doctor Earle was the only Surgeon in the army attached to the volunteers at the time you were appointed, you will rank next to him in the volunteer corps of the army; and, of course, subject to the orders of no other surgeon, agreeably to the present organi- zation of the army. Sir,- You will take into possession the Hermaphrodite Brig "Retrieve," commanded by Captain Means, to transport the troops now at Galveston and land then at Live Oak Point. You will then return with the vessel to this place, and deliver her again to the Captain or consignee. You will take especial care of the vessel. Should Capt. Means desire to command his vessel, you will permit him to do so, and discharge him at Live Oak Point. This order you will despatch with the least possible delay. -Major James H. Cooke 3 will furnish the meat rations requisite for the troops. You will have power to call on Col. Mills-i for force, should any be requisite, to carry out this order; as it is unduly necessary that the troops now here should be removed to the frontier.
