when the Indians are evidently in the settlements and committing depredations; to establish which fact the affidavit of the Chief Justice will be necessary. If the Detachment of Mr. Ballard has been mustered into the service, you will muster it out upon 1·eceipt of these orders, first notifying him that should it become necessary, upon your order, he will be called into service again. For every day in pursuit of Indians or defending the frontier you will require him to certify upon oath, else the Legislature will not be expected to pay them. And you will not order the men into service again unless actual and urgent necessity exists. Sam Houston.

Solomon C. Childress Sir: You will upon receipt of these orders, repair to the head- quarters of Captain Tumlinson's command and muster him and his men out of the service of the State upon the 15th of June, or as soon thereafter as possible. Upon mustering the company out of service, you will take charge of all Government property in the possession of the Company and should any of it be in a condition to waste by transportation, and you should deem it advisable to sell upon the spot, or in the neighborhood, you will dispose of it at the best advantage, otherwise have it conveyed to San Antonio and hold the same subject to my orders. Upon the delivery of the property into your hands you will receipt to Captain Tumlinson and report immediately to this Department. Enclosed you will find orders to the Captain. Sam Houston.
