And whereas, the President, Engineer and Secretary have re- ported under oath, that the said Forty five miles upon which said application is made has been completely graded according to the provisions of the Charter of the said Company and of the general laws of the State in force at this time regulating railroad Com- panies. You are therefore, requested to issue to the said Company, its President, ·or other lawful officers, agent or attorney, the said Three hundred and Sixty Sections of land iri land scrip of Six hundred and forty acres each. Captain Joseph Walker Dear Sir, It is the desire of the Executive to appoint you one of three commissioners to ascertain the amount of losses of our Frontier Citizens from Indian depredations, if you will accept the same. The Board, when appointed, will be expected to proceed to each of the Frontier Counties in the district assigned to it and receive testimony as to losses. As it is important that the matter should be transmitted to Congress, the coming Session, it will be neces- sary that the Board proceed to work at as early a day as possible. There being no appropriation made for this purpose, the ex- pense of the Commissioners wi'll have to be met by the next Legis- lature. The Executive is confident, however, that the necssary appropriation will be made, and he would be gratified to receive notice of your disposition to accept the appointment at an early day. It is desired that the Commissioners shall commence business by the 15th of December. Sam Houston.
