The Treasurer is not bound to account for any monies not placed in his hands, nor is the Comptroller, in any way respon- sible tor money when in the Treasurer's hands, as the Treasurer is the custodian of a11 monies placed in the Treasury. For the information of the Comptroller, therefore, I herewith transmit a copy of a letter of instructions from the Secretary of War to the 2nd Auditor, and also a letter from the Honorable John Hemphill. 2 I also send an appointment to Mr. George J. Dur- ham to proceed to Washington and adjust and settle the accounts of Texas with the Government of the United States. And I desire that the Comptroller shall place in Mr. Durham's possession all the vouchers in his hands, that he may be enabled thereby to obtain the money due to Texas from the United States, so far as the same has been appropriated. Collins, Chief Justice of Lamar County Sir: Your certificate of the organization of the "Lamar Minute Company," has been received this morning. Such companies as "Minute" men are unknown to the States regulating the Militia and uniformed volunteer companies as such cannot be recognized. If the company is organized under the Militia Law or laws governing and regulating "uniformed volunteer companies," it will be necessary that you forward to this. Department, with the Chief Justice's .certificate, a duplicate roll of your company, the original of which will be filed with the County Clerk, before com- missions can issue to the officers.
