the same, together with the whole proceedings, in reference to the conducting of said Election at Precinct No. 9, Warrant the belief that it is not only illegal, but fraudulent; and as such should be rejected by the Governor and Secretary of State. It is therefore declared that the returns purporting to be returns of Precinct No. 9 in the County of Nueces, be rejected. The matters stated in reference to the illegal establishmnt of Precinct No. 9, and the fraud in conducting the election are deemed as Secondary to the fact that a portion of the Territory is beyond the limits of the 14th Judicial District, and are only con- sidered as going to show that the rights of the party legally elected by the actual voters of the District are not affected by the ex- clusion of said Precinct. Hon. Clement R. Johns, State Comptroller Sir: In your letter of September 27th you say, that the "papers necessary to secure the money due to Texas from the Federal Government on account of Frontier defence, have been on file in this (your) office since last spring and ready for trans- mission to Washington City." The Executive regrets that-you did not apprise him of the fact earlier, as they might have been forwarded and the money could long since have been placed in the Treasury. Had you notified him of the fact as requested in his note of March 16th last, the accounts might have been arranged by our members in Congress, without any cost to the State, or such arrangements might have been made, that the money could have been placed subject to the order of this Government. As the necessary "papers" are ready for transmission, I desire that they be forwarded properly authenticated, to Washington City, as requested in my letter of March 16th. As Congress is not in session and consequently the Departments are more at leisure,
