organization of the "Bunkerville Artillery" has never been re- ceived at this Department. Besides the certificate of the Chief Justice, it will be necessary that you should file.with your County Clerk a full and complete muster roll of your company, and forward to this Department a duplicate copy of the same. Upon receipt of the rolls and certificate, the commissions will be issued. The State, at this time, has no arms of any description, except some few hundred flint lock muskets, consequently, cannot furnish your company with the field pieces with which it would be satis- fied. CONCERNING FRAUDULENT ELECTION RETURNS 1

Executive Department, Austin, October 8, 1860. Petitions from Citizens of the Counties of Nueces, Goliad, Live Oak, Refugio, San Patricio, Bee, Karnes, comprising the 14th Judicial District, urging that the returns of Precinct No. 9, in the County of Nueces; are illegal and fraudulent and should be rejected, having been considered by the Governor and the Secre- tary of State (the Attorney General being absent) : And also the proceedings of the County Court of Nueces County, establishing said Precinct, the poll books of the said Precinct, and sundry affidavits going to show fraud in the said election, it is deter- mined: 1st, That it appearing from the map of the County of Nueces, that a large portion of the unorganized County of Encinal, in- cluded in the said Precinct No. 9, established by the County Court of Nueces County, is part of the County of Webb and beyond the limits of the County of Nueces, and the said 14th Judicial District, the establishment of a Precinct including· the voters of all the unorganized County of Encinal, was illegal, and the returns of election from Said Precinct cannot be received. 2nd, That said Precinct No. 9 was not established at the 1st regular Term of the County Court of Nueces County, as required by law; but at a special term in July; and that no notice of the establishment of said Precinct was given in the order for the August election. 3rd, That the establishment of said Precinct No. 9 at a time not authorized by law, and the fact that no notice was given of
