Hon. C. R. Johns, State Comptroller Sir: There are now about two hundred convicts in the State Penitentiary, and I have been informed that more sickness is prevailing there than one Physician can attend to. I desire to know if you will audit and pay the claim of an assistant Physician at half price, so long as the necessity exists, should the director~ see fit to appoint <me? Sam Houston.

Hon. C. R. Johns, State Comptroller, Sir: Replying to your letter of the 6th, requesting to be "fur- nished with the Muster Rolls of all companies" as also with copies of such orders and instructions as may be necessary to direct the proper disbursement of the Frontier appropriation," I would say that I have considered the matter maturely and can find no authority or precedent for imposing the duties of paymaster upon the Comptroller. If the Comptroller can point me to any law or reason why such should be done, the Executive will be pleased to consider them. · Sam Houston.
