to an act approved, January 2nd, 1860, which have been mus- tered out of service, except the mintue men, who are to look to the Legislature for compensation. You will receive the muster and pay rolls from the Comp- troller, and as there is no money in the Treasury out of which they can be paid, you will issue your certificate, certifying the amount due to each officer or soldier, which certificate will be a sufficient voucher to the Comptroller for the interest Treasury warrant to issue in accordance with law; which warrant will be countersigned by me as provided by law and when the pay- ments are made the rolls will be filed in the Comptroller's office. Hon. C. R. Johns, Comptroller. Sir: You will please furnish the Executive at your earliest convenience with the vouchers or other information upon which you audited the claims of the Rio Grande troops under the com- mand of Captain Herran. I desire this information in order that the payment of the claims may not be delayed. I am ready to sign the warrants, the moment the information is furnished me. As no report has ever been made to this Department that such a company was in the service of the State, or ever has been. Sam Houston.
