William Rummey ) Citizen Sam Houston in presence of this Court, presents, and says that he has been appointed by order of the Alcalde to prose- cute the aforesaid William Rummey, in behalf of the State: And for accusation Saith that on the night of 28th day of Feb- ruary last about the hour of eight o'clock, not having the fear of God before his eyes: with a rifle gun, loaded with powder, and Ball made of lead, which he then and there held in his two hands, feloniously did shoot, one Robert Rogers thro the thigh, making a wound of one half inch in width, and of the length of ten inches. Contrary to the peace, and dignity of the State; and greatly to ·the detriment of good order, as well as to the manifest injury of the lives, safety, and preservation of the Citizens of the State Sam Houston Pros.
