AGREEMENT BETWEEN HOUSTON AND PRENTISS 1

Samuel Houston late Gov€rnor of Tennessee and James Pren- tiss of the City County and State of New York agree as fol- lows.-Viz. Houston agrees to proceed to Texas as soon as con- venient and to purchase all or part of the rights or shares of land in Leftwichs Grant in Texas so callzd upon the best terms and conditions he can on joint account of the parties hereto and that he will make the best terms he can with Co 1 • Austin and others who now claim an interest in said Grant or in a Grant lately made by the GovErnment of Coahuila and Texas of the same premises by which to obtain the said grant or any part thereof and if by any means he can obtain any part of the said grant or any interest or benefit that may arrise from or grow out of any agency relative to the same what he may thus obtain shall be equally divided between the parties herto say one half to each.- The said Prentiss has this day transferred and deliv- ered to the said Houston certificates of eight Sitios and one hun- dred Labors of Land in Dominguez Grant so called situated in Texas containing by estimate 53140.824/1000 Fifty three thou- sand one hundred 824/1000 English Acres which is estimated by the parties at six cents per. acre amounting to 31884.49 [sic] thir- ty one hundred eighty four Dollars forty nine cents which is con- sidered a joint fund to be used in the purchase of the said Leftwichs Grant and for which the said Houston has this day executed his obligation to pay 1594.22 Fifteen hundred ninty four Dollars twenty two cents in one year with interest - that being one half the cost of the said lands and by which the said Houston becomes a joint and equal owner of the said lands for the purpose aforesaid. It is agreed that in case the lands thus jointly owned shall not be wholly disposed of for the purpose aforesaid that one half. part that may remain shall be held sub- ject to the order of the said James Prentiss.- It is mutually agreed that the said Houston shall not make any bargain or con- tract for the payment of money by which to bind the said Pren- tiss for any greater sum than five hundred Dollars without first submitting the same to the said Prentiss and obtaining his con- &ent thereto.--Houston is to advise Prentiss of his progress in
