The delay in the departure of Captains Brown & Hurd enables us again lo address you. since our last Capt Brown has been again arrested on a civil suit for nine Thousand Dollars by the Louisiana State Marine Insurance Co being the value of the Cargo of the Brig Pocket, upon which suit we have bail'd him pledging the faith of the Government for Lhat amount to other securities. It will now become Lhe duty of the Government, to have the Cargo condemned by a regular Court, to have sufficient evidence forwarded of the character of her Cargo. The documents and papers found on board proved as having been taken from the vessel, and all information you may judge necessary to forward to prove the legality of the capture. The issue on trial depends, first upon the legal condemnation second on the fact of the Government de facto, & thirdly on the character of the vessel & Cargo. All these points must be proved, and the evidence must be obtained by the government, we shall as soon as possible obtain an order of Court to take depositions in the case. in the meantime your Excellency will please make such arrangements as you may deem necessary to secure persons & papers. we have no fears as to the result if the government secure the necessary & available evidence.
