State of Louisiana City of New Orleans Be it known that this day before me William Christy, a notary Public in and for the said City and parish of New Orleans,. duly commissioned and qualified: personally came and appeared Elijah Howes master and owner of the Brig Pocket, who declared that for and in consideration of the sum of Two Thousand Dollars, to him in hand well and truly paid by Mess Thomas Toby and Brochir of this City, the receipt of which is hereby acknowledged he does by these presents grant, bargain, sell and convey into the said Thomas Toby and Brother, herein represented by Thomas Toby, one of the members of said firm who is accepting and purchasing for and on behalf thereof the said Brig Pocket of the burden of about one hundred and forty together with all her tack.le apparel and furniture, which Brig is noted or was when last seen by the said vendor in Galveston Bay and in the possession of the government of Texas, she having been taken possession by Captain Brown Mastiz of the [illegible] , a Texas armed vessel it being well understood that said Barg Pocket shall be considered as having been at the risk of said purchased from the time she was taken possession of by the said Captain Brown, as aforesaid: and it is further understood and agreed that the said Vendor shall and does by these presents transfer to the said purchaser all the rights of action and claims of every kind which he may have under any policy or policies of insurance for all losses, damages and injuries, which already have occurred or may hereafter arise in consequence of any injury. Whatsoever of to the said Brig Pocket and that he will end or see over the policy of insurance of the said vessel to the said purchases, as soon as he can get it in his possession. [illegible] To have and to hold the said Brig Pocket, unto the said purchasers, thing [ illegibie[ no thing proper [illegible] and behalf forever, and the said Vendor for himself and his said Brig Pocket of the said purchasers, his heirs and assigns shall and side warrant, and for ever defend a gained the lawful claims of the persons whomsoever, by these presents.
