Army. this moment the convention has voted that they will sustain the army in their present position or any that they may occupy-when you elect your officers & the ranks they hold in the volunteer corpse now in camp, send in proper certificates of the same to the Gov. & council, that you may have commissions immediately sent you, which will establish your pay, rank &c, &c- The importance of keeping Gov. & council advised of your wants must be apparant, & I hope they will be constantly in posession of views-Mr. Gay is making arrangements to forward the 18 pound cannon now on board the San Felipe-an action is supposed to have taken place a few days since between the San Felipe· & the Montezuma-off Matagorda, fro~ the firing heart, but nothing yet has been heard certainly from her-You will see a recommendation that Messrs. Thompson & Gage in confinement in your camp be sent here for trial or let to bail to ans. I think perhaps il would be well to do so. I drew up that recommendation al the suggestion of the delegation from San Sugustine-Let me heare often from you.

The foregoing matter of seeming difficulty haveing been transmitted to me by the Legislative Council of Texas in l.ter provisional form of Government and having been di1ly elected & sworn to perform the duties of the Executive Department of that Govt. Therefore in the recommendations of the Council, in order that all misdemeanors be submitted, and tried by the proper authority You are hereby required, in conformity with the suggestions, and recommendations of the Council that the same be
