San Felipe de Austin Oct 29th 1835

To the President of the general Council of Texas Sir

I have been honoured with a copy of a Resolution of the general council of Texas passed on the 27th lnsl. in which that body directs "That all the Land Offices be closed-That all Commissioners cease to grant orders of surveys-That all transactions in regard lo public lands whatsoever shall cease until the consultation meet and act on the subject" &c In reply I will briefly state Thal, I do not recognize in that body the right to prevent any law of the state from being carried into effect, or to interfere with any officer of the State in the discharge of the duties imposed on him by that law. That, I do not admit that this council, the consultation, or any other power which may be established by the consultation has, or can have the authority to deprive individuals of the rights which they have acquired by virtue of the laws of the land. Against this principle our felJow citizens are now in arms. With regard to the implication of fraud contained in the preamble to this Resolution, I have only to say, that no act of this office has ever operated lo the prejudice of individual rights- And in conclusion, 1 heg leave to refer the Council to their address to the People of Texas of the J 8th Inst. in which they call upon them to "march to the field of battle" in defence of their rights and the Constitution And would rc~spectfully enl(Uire how that act comports with the Resolution in question?
