Dear Sir

We are pressing forward, in the opperation of the Fort and find it necessary to call in the outlyers and plunderers as well as our good Citizens who timerously has taken refuge in the bottoms and Cane breaks. Such Now Constitute a large Share of our force, which has been added since the Commencement. Sarni. Harder, a free Molatto has left us Clandestinely for that place, and for the sake of Example and precedent we hope You will feel as much interest in delivering him up as we to ask it into the hands of Mr. Grayson the bearer Care of Govt. and our Country Thos 8. It has become necessary to establish a court with maratime

jurisdiction.

A Prize, of considerable value, was brought into Galveston a few days ago, by Capt. J. Brown, and until a competent court is obtained to adjudicate the case, and it is obviously improper to detain her long before a trial is had. The Government has passed a decree to establish the District Courts, and the Supreme Court under the constitution. But we find a difficulty in selecting the several Judges. You arc spoken of as the Chief Justice, and would be immediately tendered that appointment, could we then get along well. But we want an able judge in the District Court, where the trial must commence and where it will probably terminate. Under this view of the subject, we have thought ii best to ildcr appointing a Chief Justice probably until Congress shall act on the s11hj1~r.1: possibly
