patriotism, fidelity and abilities, have constilutcd and appointed, and by these presents, do conslitute and appoint you the Agent of this Government for the purpose mentioned in the foregoing part of this commmission. You will, in all your intercourses and correspondence with our brethren of the above mentioned States, be governed by a profound sense of the mutual interest, the common origin and Kindred Ties existing between them and the people of Texas. You will be expected lo keep this Government regularly informed of your proceedings, and, in the present emergency of this country, I cannot impress, upon you, too earnestly the importance of dispatching to our assistance, immediately whatever means, either in men, money, provisions or munitions of war, which the liberality of our brethren, il'.l the United States, may, in this hour of need, place at your disposal. Art. 1st. The Mexican troops having placed their artillery at a distance of one hundred and seventy paces and having opened fire, we raised a white flag and at once Colpnels Juan Morales and Mariano Salas came in company with Lieutenant Colonel Juan Jose Holsinger of the Engineers, and we proposed to them to surrender ourselves at discretion, to which they agreed.
