that it is not such an act as the law of Congress notices; and we may say further, that it is not shown that it contributed in any way to promote the enterprise, by further supplies of either men, money, or means. As regards, therefore, a connexion with Mexia's expedition, or the violation of the law by the defendant, (and penal enactments must be construed strictly,) there is not sufficient evidence to cause him to be held to bail. In a great degree the testimony goes to establish the negative. There is no evidence of the setting on foot any warlike enterprise or military expedition, excepting that of Mexia, which has been noticed. The defendant, William Christy, is discharged.
