. l\farch 19, 1836 To all whom it may concern, know ye, that I David G. Burnet President of the republic aforesaid and with the advice and consent of my Cabinet having full power vested in us lo that effect, reposing especial trust and confidence in the integrity uprightness and conduct of Thomas Toby & Brothers of the City of New Orleans, do hereby nominate, constitute, appoint and confirm them the agents of the Government of the Republic of Texas, and they are hereby fully, amply and Completely authorized and empowered for and on the part and behalf of the Government, to sell, alien, and dispose of and confirm free from charges of office fees, Government duties or dues, and in fee simple title three hundred thousand acres of land at and for such price and sums, and in such quantities and upon such conditions as they may be by the executive of this Government directed by the written instructions herein furnished

New Orleans March 19th 1836
To the Hon. Richard Ellis, President of the Convention Sir,
I wrote a proposition a few days since to Genl. Houston with a request that it be laid before the authorities of Texas-Since which I have been advised to address your Government directly as Genl. Houston may be engaged and not able to attend to it-Col. Williams of Texas advises me to this course with much solicitude- My simple proposition is this.- I will bring three Regiments from Tennessee at least, but desire the power to bring four, if your Government will give me my present rank, with the power to appoint all the Officers under my command.
