Gov. Smith-

Sir, I received your "very polite" note of "specifications & charges"!! (a reversal of orders by the bye, rendering your object exceedingly ambiguous), the day of the date thereof. I regret lo inform you, that I had on Monday previously resi~ncd my seal in the "general council," and which was supplied by Barllell Sims Esq. an old acquaintance of yours, & a member from Mina. Conse- quently, under the Organic law, there can be no farther proceed- ings, for the penalty, "dismissed from office" cannot be executed. The charges &c. under the same law, against me as Judge Advocate Gent &c are premature forasmuch as T have not taken the oath of office. Therefore, "malfeasance and misconduct in office" can hardly be predicated on myself in that capacity. I will, however, take the oath of office on tomorrow, & report myself to the proper authorities, after which, if you are anxious to continue the exercise of a persecuting spirit towards one who never injured you, in God's name, gratify your utmost motives, and if I do not vindicate myself to the confusion & shame of all such enemies, then am I willing to be given over to the buffetting of the Devil & his Imps. 1 leave lo you to your own volition, as regards myself hereafter with the assurance that my course will be defensive only, but to the last extremity, will I contend against calumny & oppression.
