Specification 4th Defamation & Libel

Charge 1st

For defamatory and libelous remarks as set forth in a printed publication under date of the 11th January last, past, addressed "To the people of Texas" by way of recrimination, writing aiding and abetting, countenansing and circulating the same knowing it to be false and also endorsing, recommending, publish- ing & circulating a defamatory and libelous letter written by your Genl. Agent J. W. Fannin, and circulating the same for the purpose of bringing the Govr. into contempt, and at the same time knowing il to be false, which printed and defamatory document bears dale 26th January last past, And for other base and slanderous remarks issued and circulated by you contrary to all principles of truth and common honesty and beneath the dignity & character of a Member of the Council or an officer in the Army. Specification 5th Bad faith Charge 1st For procuring, counselling, aiding & urging the appointment of Edward Gritton Lo the office of Collector of Revenue for the port of Copano, knowing him to be a spy, as charged in my secret correspondence to a secret session, under dale of the 17th Deer. last past, in which yourself was also implicated, and as also declared by Col. Powers, a Member of the Council, clearly evincing by your conduct that you had so amalgamated yourself with the friends and emissaries of the Dictator, that you are not worthy to be trusted either on the Council or Army of the free and sovereign people of Texas. Charge 2d For advising, counselling, aiding and abelling the breaking of the Seals of secrecy and publishing to the world your own infamy, as evinced in the publication of the secret correspondence addressed to a secret session of the Council, of which you was a Member, under date of the 9th Jany last past. And for universal bad faith as evinced in many and various instances. Specification 6th Swindling For passing through the Auditors and Comptrollers offices a spurious or countcrfcit nole purporting to be on some bank in the City of New Orleans for the sum of $50, knowing it lo Le such, and for which you have received a check on the public treasury as the above named officers can testify, You pretending to have received it from the Government, which you know to be false. And finally being h'uilty of First Perjury 2d Fraud and Corruption 3d Treason 4th Defamation & Libel 5th Bad faith 6th
