Charge 2d For counselling, aiding and abetting in menacing the Executive Secretary, compelling him by thr1;,;ts to give up various archives belonging to the Executive office and refusing to return the same, with various other Treasonable acts. Charge 3d For counselling, aiding and abetting in subverting the Provisional Government by attempting to depose the legitimate Governor as per resolutions bearing date l 1th January last past, and as per the treasonable and libelous documents in print, signed by you, under the same date, directly deregotary to the Organic Law, which you was solemly sworn to support, contrary to your duty as a Member of the Genl. Council and contrary to your duty as an officer of the army. Charge 4th For counselling, aiding, abetting and recogmsmg J. W. Fannin agent, as set forth in Specification 2d Charge 4th as per your endorsement and publication of his libelous letters published in San Felipe bearing date 26th January last past. Thereby disorganizing the Army, subversive of all organization, and with a premiditated intent to supercede the legitimate Commander in Chief, contrary to your oath and duties as a Member of the Genl. Council and in direct violation of your duties as an officer of the Army. Charge 5th ' For counselling, aiding and abetting in producing disorgani- zation_and confusion in the Army, by appointing and recognizing persons as Commanders and Genl. Agents, to wit, F. W. Johnson, J. W. Fannin, Dr Grant, and others as set forth in the preceding charges; persons entirely unknown to the constituted authorities, placing means at their disposition and endeavouring by intrigue and base management to place vessels, to wit, the armed vessel Jnvincihle at their disposition, as per resolutions under date of the 8th January last past, predicated on false premises, for the purpose of making predatory war upon our Neighbours, contrary to the solemn declaration of the 7th Nov. last, at direct war with the constituted authorities and total subversion of the Organic Law., and with evident intent and design lo supercede the Commander in chief, contrary to good faith, contrary to your duty as a Member of the Council, and in direct violation of your duty as an officer of the Army.
