Council and contrary to your duties as an officer of the Army. Charges 4th For counselling aiding and abetting in the passage of an Ordinance under date of the 7th Jany appointing J. W. Fannin as Genl. Govt. Agent to contract loans fit out expeditions, controul armies, make descents at pleasure on the faith and credit of Lhis Govr. recognizing him as such agent, by your recommendation and endorsements of his libelous lellers published in San Felipe headed "Circular" bearing date 20Lh Jany last past, thereby producing disorganization aiding and abetting predatory warfare on our neighbours, contrary to the Declaration of the 7th Novr. contrary to the Organic Law, contrary to good faith, contrary to your duties as a Member of the Genl. Council, and contrary to your duty as an officer of the Army. Charge 5th For counselling, aiding and abelling and controlling the public property, to wit, a number of Horses, ordered out of the possesion of Mr. Mercer, in whose charge they now left, converting the same, keeping them in the town of San Felipe at the public charge, thereby defrauding the public, and in divers and various ways creating claims against the public treasury, contrary lo your duties as a Member of the Council, and contrary to your duties as an officer of the Army. Specification 3d Treason Charge 1st For counselling, aiding and abetting in declaring the Executive office vacant, and attempting lo depose the legitimate Governor of Texas by force, and demanding peremptorily all the archives and public correspondence of his office, by an individual purporting to be an officer, unknown lo the law, styled a i\'larshall, with a menacing and insulting notice that two hours only were allowed for a surrender, which notice bears date the 19th day of Jany ·last past. As also subsequently by resolutions purporting lo have been passed by the Council of ,vhich you was a Member, requiring the said person, styled a i\larshall, that if an immediate surrender was not made on the part of the legitimate Governor thal he should resort to force.
