commission in favor of McKinney & Williams, and one in favour of T. F. McKinney to contract loans for the use of Texas, each for the sum of SJ 00,000 responding to all enquiries that the said Commissions had been returned and were then, knowing the same to be false, contrary to good faith, contrary lo your oalhe as a member of the Council and contrary lo your oath as an officer of the army - and for various other similiar acts. Specifications 2d Corruption and Fraud Charge 1st For counselling aiding & abetting as a Member of the council, the drawing framing and passage of a Bill in the Genl. Council, requiring the Governor to issue a commission to McKinney & Williams to contract a loan for the Government selling forth in said Bill, and by various oral declarations, that certain commissions as set forth in Specification 1st Charge 3d, had been returned to the Council, knowing the same to be false; thereby, leaving it in the power of said McKinney & Williams to defraud this Govt. in the sume of $200,000, contrary to good faith, contrary to your duties as a l\'lember of the Council, and contrary lo your duties as an officer of the Army. Charges 2d For counselling, aiding and abetting as a !Vlember of the Genl. Council, and as an individual, in committing fraud on the public Treasury, by furnishing out fits to Col Gonzales, (a Mexican,) the sum of $500, contrary to laws. And by creating claims on the treasury in your own favour, to wit, one as an account of out fit and expenditures of yourself and Edward Gritton on your mission to confer with Genl. Cos at Matamoros, and various others in your own favour and in favour of others, To wit, The recognition of the certifrcale of Doctor Grant, a foreigner unknown to the constituted authorities for the sum of $750 and also claims in favour of various other persons as the Auditors & Comptrollers, books and accounts will more clearly show, contrary to common honesty, contrary to law and good faith, contrary to your duty as a Member of the General Council, and contrary to the honor, and duty incumbent on you as an officer of the Army. Charge 3d For counselling, aiding and ahctling the Contracting of a loan of Money through Thos. F. McKinney for F. W. Johnson say $1800 to $2000 to fit out, or aid, in an expedition against Matamoros, He, the said Johnson being unknown to the constituted authorities of the Government, therehy making the Govt. account-
