Charge 3 For treasonable practices, against the Government and People of Texas

Specification 1st under charge 3

That the said Henry Smith late Governor of the Provisional Government aforesaid, since his suspension by the General Council and joining issue to their charges, has asserted the right of acting officially as Governor, by receiving and answering the public correspondence of our Foreign agents to the United States and other persons, by withholding from the acting Governor and General Council, such correspondence of a public nature, as of right belonged to the existing authorities, thereby embarasing the operations of the Government in all its means of defence and greatly endangering the lives of our citizens and the safety of the country and further the said Henry Smith, has continued to act officially since his suspension &c as aforesaid, by issuing army orders to Lt Col Wm B Travis, to Lt Col J S Neil & Gen Sam Houston and other officers of the army and has endeavored directly to embaras interrupt and prevent the movements of the army now concentrating upon Matamoros, and in every possible manner in his power endeavored to disorganize and distract all the operations of the Government and the army engaged for the defence of the country. Specification 2d under charge 3 That Henry Smith late Governor as aforesaid, did in his aforesaid letters to J\faj Wm Ward and Col Wm G Hill as set forth in specifications 1st 2d & 3d under charge 1st threaten that he would break the "damned necks" of the Council and that they should welter in their own blood and did boastingly declare that if he could not destroy he would cripple the operations of the General Council, together with many other threats made to divers good citizens of Texas, to destroy the Provisional Government, thereby reducing the whole country to a state of anarchy and confusion, and further the said Henry Smith did with a traiterous design against the said Government publish in the Nacogdoches and Brazoria papers, that the General Council was adjourned until the first of March next, well knowing the same to be false.- Specification 3 under charge 3 That the said Henry Smith late Governor as aforesaid, did on the 2d day of Feb inst, in an insulting note sent to the members of the General Council by one Thomas R Jackson with traiterous intentions against said Provisional Government and th~ People of Texas demand certain papers or documents belongmg to the records of the General Council and did wickedly and traiterously
