[2073) [THOMSON and CLEMENTS to SMITH] To Henry Smith late Governor of the Provisional Government of Texas Sir In addition to the former charges and specifications prefered against you by the General Council of the Provisional Government of Texas, you are notified that the following, will be also submitted to the same Tribunal, which you have selected for your trial, for official misconduct &c.- Charge 1st For libelling the late volunteer army of Texas, and the General Council of the Provisional Government.- Charge 2d For embezling the Public funds of Texas.- Charge 3d For treasonable practices against the Government and people of Texas.- Charge 1st For libelling the late volunteer army of Texas, and the General Council of the Provisional Government. Specification 1st under charge Isl That Henry Smith late the Governor of the Provisional Government of Texas, did on the -- day of -- in a letter addressed lo Maj Wm Ward then at Velasco, mouth of the River Brazos, did maliciously, wickedly and libelously, call the patriotic volunteer army of the people "a mob nicknamed an army" in his said letter lo the aforesaid Maj Ward, and in the same letter, says "I am threatened with assasination by an internal enemy at home" (meaning hy the volunteer army aforesaid) and he further says in his said leller to Maj Ward, "I will ere long throw them a fall which will break their own damned necks and they shall welter in their own blood" (meaning the members of the said volunteer army) and the same or similar language he has often used to divers good citizens when speaking of the late volunteer army of texas.- Specification 2d under charge l st
