Department of Stale, Washington, February 6, 1836. Sir: Herewith you wiU receive an extract from and copies of papers that accompanied a letter of Mr. D. W. Smith to this Department, dated Lhe I st of last month; from which it appears that, in consequence of his representations, the passengers and crew of the schooner Hannah Elizabeth had been set al liberty, but that the captain was still detained. You will, therefo;e, consider the inslruclions to you of the 29th ultimo so far modified as to require you to demand the release of the captain only, and satisfaction for the detention and maltreatmenl of him, the passengers, and crew.
