Matagorda February 4th 1836
To the Honorable the Governor and Council of Texas
Your petitioner would humbly represent that on or about the eleventh day of January One thousand eight hundred and thirty six, he set sail from the port of New Orleans on board the Schooner Brutus, in company or about the same time with the Schooner Aurora, on both of which vessels he had shipped goods to be landed at the port of Matagorda (Texas). That both vessels anchored within the Bay of Matagorda, al the anchorage on or about the nineteenth of the same month. That on landing, duties were required of him by a custom-house officer, who had been appointed by your Honor- able body during the absence of your petitioner, of which appointment your petitioner was entirely unacquainted. That upon declining to pay them, for the reasons herein- after named, heavy bonds were required, by the aforesaid custom- house officer for their payment, which were given. Thal upon inquiry "The ordinance and decree Establishing and irnposincr Duties on lmporlalions and Tonnage and for other purposes" did nol receive publication in the stale paper of kxas until the ninth day of January one thousand eight hundred and thirty six only two days previous lo the lime of setting sail from New Orleans and ten from the day on which he landed al Matagorda.
