10th. The Executive authorized Buoy to do as Johnson wished to do. 11th. He pressed letters of mark & reprisal. 12th. He urged the appointment of Gen. Houston Indian Com. 13th. Induce him, if possible, to pause in his mad career, & save the country. 14th. 1st. H. Smith says he has been for the last two weeks constantly imployd in counteracting the proceedings of the General Council. 2d. He says that the dissolution of the council will not produce any injury. 3d. Said he knew all that passed in the Council - had spies &c. Strongly recommending the appt. of the comdg. Genl. to treat with Indians, & after appt. ordering him to the West &c.

[1974] [MOODY to COUNCIL]

To the Honourable the President and Members of the General council.

Gentlemen [January, 1836] being in the lobby on yesterday when the governors message was recd charging a part of the council with corruption and the like, and understanding it was a question submitted to the people. I as one having the best wishes at heart for the welfare of Texas, beg the indulgence of offering you a few remarks for your serious consideration. 1st in the first article of the organic law, it is declared there shall be created a provisional government to consist of a governor, lieuten- ant governor and a general council it would seem to me the whole three coordinate branches must exist at the same time to give action to either. In the second section it declares in case of death absence or other inability of the governor during which time a president protempore shall be appointed to perform the duties of Lieutenant governor in the council clearly shewing by inference that the Lieutenant governor must fill the vacancy of governor by such defalcation of the governor a question would here arise docs a refusal to act as governor or rather to correspond with the council amount to such inability as contemplated. I think most clearly it does. then in that case the council stands justified in obeying the Lieutenant governor
