To Thomas F. McKinney Esqr 1n the name of the People free and sovereign
Reposing special trust and confidence in your patriotism, knowledge, conduct and fidelity, do, By Lhese Presents, constilute and appoint you as you as special agent of the Provisional Government of Texas, Lo contract a loan to the amount of One hundred thousand dollars, to be applied to the uses and exigencies of the Government of Texas. And you are hereby vested with full power and ample authority to secure the payment of the said loan by hypothecaling the public lands of Texas and pledging the faith of the country. In executing Lhis trust you will conform to, and be governed by the instructions transmitted to you by the previous Council of Texas, which was ratified and confirmed by the chosen delegates of of all Texas in general council in convention assembled on the -day of-the present month, and by a subsequent ordinance of the Legislative Council of Texas authorising and empowering me as Lhe Supreme Executive to extend to you a commission cloLhing you with full and ample powers to proceed forthwith to the city of New Orleans, or elsewhere, and contract the said loan in conformity with the instructions as above recited. Therefore lo whomsoever these Presents shall come, be it known, that I, Henry Smith Governor of Texas, by virtue of the authority vested in me by the people of Texas sovereign and free, Do by these presents, authorise the above named Thomas F McKinney as agent on the part of this Government with full and ample powers to contract for the above named loan of one hundred thousand dollars, and as security therefor to hypothecate the public lands and pledge the faith of the country. And that all contracts stipulated and entered into by the said agent by virtue of this commission shall be recognised as lawfull and binding on the
