Ncw Orleans, January 5, 1836.

Charles Bishop, being duly sworn, deposes a11d says, that aboul two or three weeks ago he had a conversation with R. .M. Carter, Esq., al his office, relative lo a vessel which was filling out in this port al that lime He does not know lhe name of that vessel; he did not know that the vessel was intended lo cruise against Mexican vessels, or only lo protect herself i11 her trade to Texas. The vessel he spoke of was the vessel now owned by Mr. Alle11. At the time that he had the said conversation with Mr. Carter, he communicated lo him what he had heard from public report. He knew nothing, by himself, of the armament of said vessel. Charles Bishop. Sworn to and subscribed before me, Gallien Preval, Judge.

Henry Lockett, being duly sworn, deposes and says that he has no knowledge of any vessel filling out in this port with the intent of cruising against Mexican vessels. He never heard of the Brutus until he saw the communication addressed to i\lr. Carleton, and signed by many merchants of this city. He k.nows nothing about said vessel, except what he has heard from public report. He never spoke to Mr. Carter in his life about the Brutus, to the best of his recollection. H. Lockett. William Bryan, being duly sworn, deposes and says that he knows nothing about the schooner Brutus being fitted out in this port lo cruise against Mexican vessels. He knows, on the contrary, as the agent of Mr. Allen, and from the instructions he received from him respecting the said vessel, that she was bought by Mr. Allen with the intention of sending her on a regular trade from here to Texas; that she was advertised accordingly in the newspapers.
