Head Quarters Victoria 2nd Sept 1836

To His Excellency D. G. Burnet President Sir

Some days ago I received your communication enclosing amongst other documents an order to strike the name of Lt. Col. Henry Millard from the rolls of the Army immediately after which I believe the next day I received your letter under date of 13th Instant in which you say, "I wrote you a few days ago and transmitted some documents in relation to Lt. Col. H' .Millard should thatofficer prefer an investigation by a Court Martial he may be indulged by standing his trial on a charge of high treason & Sedition." & yesterday I received duplicate copies of your 1st communication. I informed Col Millard of the facts & he prefers an investigation. It will therefore be necessary that charges and specifications be made out and sent on and that proof be forwarded. It is also necessary that a commanding officer for the Battalion of Regulars should be appointed as Col. M. is the only one above the grade of Lt. now in command in that Battalion upon the subject of Captn Wneelock he reported to me as a Captn of Rangers under Col Bane or Burton he is not now in the army and whether holding his office of Captn or not I do not know as I have not seen his commission or the evidences of his appointment he was at the time he visited Velasco recognized as a Captn of Rangers on the authority of a communication from yourself relating to the Indian expedition upon which Genis Green & Houston were ordered some time since. If there are any Books or authorities at Velasco on the subject of courts martial I will thank you to send them out at the same time you do the charges & proofs as we are destitute of Bo_oks here and in a case of this kind it is important that our proceedmgs be based upon correct legal principles. I am just getting upon my feet from an attack of fever I have on account of health & provisions changed the encampment of the army they are now encamped mear Dimmitts I shall if able to ride join them tomorrow.
