[3557) lDEY AND CURTIS lo BURNET)

New York 28 June 1836

To His Excellency David G. Burnet President &c. Dr Sir

We have lo congratulate you on the propitious events which have recently taken place in Texas & the hopes that ere this not only peace has been established but thal prosperity attends you. Soon we expect the Government of Texas will undertake the regulation of its civil affairs and it seems lo us important that the Galveston Bay & Texas Land Company should represent its claims & be ready to act when the Government shall award lo them what may be their due. In view of this malt.er we have forwarded a power of attorney lo Major Lorenzo de Zavala Junior to act on our behalf & have asked of him lo make the best arrangement he can for us, limiting him however not to accept a smaller amount in land than the premium lands. We have said Lo him in substance "That in this comp.any was combined the several grants made by the Government of Coahuila & Texas, One to his Excellency David G. Burnet, one other lo his Excellency Lorenzo de Zavala & two others lo Joseph Vehlein which were sever;illy transfered to Anthony Dey Wm H Sumner & George Curtis in trust as a joinl stock company for the benefil of the several parties interested thcrin. Three of those contracts expired in December 1835 & the one to Mr Zavala has some Two or three years yet unexpired. Before the expiration of lhe grants or conlracls the provisional Government slopped the further colonization of the lands al a period when several of the members of this company having procured orders of survey and having actually surveyed their lands al an expense of scvcrnl thousand dollars were ready to have them occupied by their settlers. Although .their actual loss has been great, ycl they desire not lo complain, in as much as the peculiar slate of the country, may have required the~adoption of the rm!asurcs pursued for general good. It however remains for the Cov(:rnrnunl lo do justice to the several parties according to their respective situations. The Com• pany arc willing lo arrange their claims upon just & fair principles, & lo accept from lhc Government a specific quantity of land which they have the liberty to select & locate within the respective grunts in lieu of all claims & to surrender up their 6rrants & cancel the sanw & all further claims thereon. Thal we deem it I.Jut an act of juslicti
