Fannin lhc officers of each army then mel they then proposed a treaty to our men Col. Fannin then entered into a capitulation with the mexicans Lhe arliclcs were then drew up, and signed by the officers of each army. it was expressly stipulated in the articles tlrnl our men should be treated as priscnors of war all private prop~rty should be respected belonging to our men and al the end of 8 days our men should embark on board vessel for new orleans tho they ware required to take an oath that they would never take up arms against the mexican government again. Col. Fannin and men ware then marched back lo the fort orders were then issued by Santa Anna Lo have them shot the was not complyed with by the Commander who took Fannin the second and third order was sent before complyed with the 8th day they were marched out in four devisions and shot there was about twenty that made lhere escape al the time tho some very much wounded. I saw most of Lhe men as they came in the mexican army then marched for the Colonys in three divisions we then had about 400 men in the field lo contend against there forces our army ware then on the Gaudaloupe River our army reinforced slow and had to retreat we retreated east of the Colorado river and there encamped untill the mexicans came on the other side we lay there for several days and then retreated east of Brazos the enemy still in [illegible I one division of the enemy crossed the river below us of about 800 men still keeping up the line of march for the east. Our general then took up the line of march after them we headed them on the San Jacinta we ware 1100 strong we left our sick and bagage with about 400 men we march with the balance lo give them battle we met with them the next day and cannonaded each a little without any loss on our part and but little on theres in the evening of the same day there Cavcllry and ours had a smart skirmish we had mans thigh broke who died some time .tflcr lhe enemy sustain some loss by the opperation. This was on the 20th day of April on the 21st they received a reinforcement which augmented there numbers to about L500 strong our number about 800 wc ware encamped Lhc11 with half a mile of each other in plain view our officers determined to give them a hc1tllc al 4 oclock in the cveni11g, accordingly al the above stated lime the drum h,~al a ii;e11eral parade which was cheering to every mun we then nrnrchcd up with 763 men u11d
