he feels deeply indebted to you for your kind exertions in his behalfr and is desirous of thanking you in person for the favours conferred I should have entered fearlessly on the duties as Commissioner but Dr. Everet thought it advisable as I had receh·ed the appointment of Judge that I should decline it. the latter being a Judicial and the other an Executive .Appointment I regret, deeply regret the delay occasioned by it, as Mr. 89 has not been heard from, and the Ilarpies here will avail themselves of it, it has just been mentioned to me that Ur. Berry and Judge Roag will not recognize the authority of the Convention or of the Legislative Council, and will only acknowledge the Constitution of 24 and the officer elected under its provisions and sworn to its support those Gentlemen have been persuaded to this course by the few I have mentioned in a former lettcr 100 and who are doing everything in their pow·cr to counteract the Provisional Govern- ment in the administration of the affairs of the Country the examination of the Land office and the declaring null and void the fradulent sales of large grants is the moving cause, I am con- vinced· a great deal of Villiany will be disclosed when the whole is examined before a just and impartial Tribunal it i somewhat amusing to witness the conduct of these men when ever any intelligence reaches here that [is] not .in accordance with their views. they sum- mon a few of their particular Confeclarate. together, and adopt reso- lutions etc and then publish them as the acts of the Committ e I bould be glad to know such !\fen ought to be proceeded ag-ainst it is possible their opposition may yet be quickly controlecl hut they deserve severe puni hment. Ien who will not sustain the authorities and laws of the Convention I look upon, and they ought to be regarded only as enemies · I shall make.a formal demand of I\fr.
