THE AUSTIN PAPERS. 429 so derived shall be from time to time divided between said parties hereto in equal moities. And it is furthermore covenanted and agreed by and between the parties hereto that a joint and equal copartnecy is established between said S. F. Austin and said Hawkins in all matters and concerns touch- ing the lands to be·granted to them or either of them, or touching the emoluments or profits claimable from said Gr::mt of lands or to the sale or settlement thereof, and all other purposes and objects in which they may embark in said province of Texas. The· said Austin furthermore covenants and agrees to cause as many individual grants·of lands to be made to said Hawkins and himself and to such persons as tthey shall name as can be obtained from the proper a.nd legal authority in said province of Texas, and in all lands, granted to said Austin and lfawkins either party is at liberty to consider himself a joint owner should he elect to do so. In embarking in objects requiring additional clisburcements of monies or monied responsibilities it must be done by joint and mu- tual consent. ,vitness our hands and Seals this 14 Novr 1821.

Cuanrlo el Gov 0 r _de T_exas recivio cartas de D_n Estevan .Austin, desde Natchitoches, dirigio copias traducidas ala Superioridud, diciendo lo que sigue. El comicionado para el estableciruiento dela nueva Colonia en esta Provincia Dn Estevan Austin, acaba de dirigirrne descle Natchitoches las cartas 2 que traducidas a nuestro idioma por el Senor Baron de Bastrop, paso en copias a manos de V. En las referidas cartas representa varios puntos interes::mtes al mejor establecimiento ala nueva ·Colonia, que sin embargo de que el tiempo exije pronta resolucion no estando en mi autoridad resolver alas clausulas que expone, espero qe. V. tenga abien dictnrme las providencias en todos los particulares que tratan dichns cartas, ex- poniendo yo a V. por mi parte cunnto en mis cortos alcanses siento, y es, que respecto ala penosn y dificultosa marcha que hay descle el terreno'del nuebo establecimiento a esta Capital, y tarda comunica- cion desde esta a esa Superioriclad, soy de parecer combiene nombrarse un Comicionado general ·con las estenciones que expone, y que este pueda serl6 el mismo Dn Esteban Austin por ser un sugeto ya conocido,
